Kimmel made the "joke" during the Oct. 30 episode of his late-night talk show "Jimmy Kimmel Live!"
"I don't know if you know about this, but we have an election coming up," said Kimmel during the Oct. 30 episode's opening monologue. "I feel relaxed about it, I've really been enjoying the week. It's times like these it's important to remember that cannabis is legal in our state."
"If you can vote early, vote early. If you can't vote early, vote on time," said Kimmel. "If you want to vote for Trump, vote late, vote very late. Do your voting on Thursday, or maybe Friday." People were quick to point out how a conservative was imprisoned when he made a similar joke in 2016.
That year, social media influencer Douglass Mackey sent out a meme to his 58,000 followers on Twitter that jokingly told voters they could "avoid the line" by voting for former Secretary of State Hillary Clinton from home if they would just "text 'Hillary' to 59925."
Mackey has maintained his innocence and said the meme was just a joke. In March 2023, he was convicted on a charge of conspiracy against rights, namely election interference and attempted voter suppression, and sentenced to seven months in prison.
Legal analysts note that the charge against Mackey – in the very liberal United States District Court for the Eastern District of New York – was clearly "outlandish," and may have been a means of creating a precedent for applying a similar charge of conspiracy against rights to Trump – a charge that could land guilty parties a maximum penalty of 10 years in prison.
But given that precedent has already been established against Mackey, conservatives are now calling for the same "outlandish" application of the law to be administered against liberals like Kimmel.
"The Biden administration sent Douglass Mackey to prison for making this exact joke," pointed out conservative political commentator Matt Walsh. "I'm dead serious when I say if Trump wins he should have Jimmy Kimmel arrested and jailed. Force these scumbags to live by their own rules."
Mackey himself weighed in on Kimmel's joke, pointing out how unfair it is that the Hollywood A-lister is still a free man.
"When I made an election joke, the Deep State used it as a pretext to conduct a fishing expedition against me, subpoenaing all my financial records, leases, employment information and pay stubs and email accounts," he said. "Will Jimmy Kimmel enjoy the same?"
