Humphrey said he has filed a probable cause affidavit with the Oklahoma Attorney General's Office focused on the agents who raided the home of federal firearms license (FFL) holder Russel Fincher in Tuskahoma, Oklahoma on June 16. The state legislator added that he has been working with the sheriff's office of Pushmataha County, where the incident occurred. He and the sheriff's office are asking Oklahoma Attorney General Gentner Drummond to open an investigation into the ATF agents for extortion, terroristic threats and misuse of their authority as law enforcement officials.
"When you abuse your law enforcement position, I think you ought to be arrested," Humphrey told the Epoch Times.
The ATF has come under fire in Oklahoma recently for the raid against Fincher, a high school history teacher, Baptist pastor and part-time gun dealer who has held an FFL for three years.
His current ordeal began in April when the ATF reportedly requested permission to inspect his home-based gun business. However, the situation escalated dramatically in June when the ATF raided his business.

The raid on Fincher's business involved at least seven ATF vehicles carrying over a dozen armed ATF agents. The agents handcuffed Fincher on his deck – all while his 13-year-old son was watching the raid – and allegedly coerced him at gunpoint into signing pre-prepared documents terminating his FFL.
During this encounter, Fincher reported that the ATF seized more than 50 of his personal firearms, worth an estimated $50,000 to $60,000, claiming they were "evidence." His business was also shut down.
Humphrey, who has worked for the Oklahoma Department of Corrections for over 20 years as a probation officer, said he believes the ATF agents abused their power by intimidating and coercing Fincher into giving up not only his FFL but also his personal property.
"I've looked up all the statutes that I believe were violated," said Humphrey, who is accusing the ATF of not clearly stating what crime, if any, Fincher was accused of when the agency conducted the raid.
Ashley Stephens, a resident agent in charge and the public information officer for the ATF's field office in Tulsa, claimed that the assertion by Fincher and Humphrey that the agency is confiscating guns for no reason is wrong.
"This is a mischaracterization of what happened," said Stephens, who further claimed that, under the ATF's administrative guidelines, agents are only able to seize guns they have been authorized by the court to seize. "We can only seize what the court tells us we can seize."
