Rep. Thomas Massie introduces federal constitutional carry bill

Rep. Thomas Massie (R-KY) introduced a federal constitutional carry bill, the Real Constitutional Carry or HR 9534, on Sept. 11. Constitutional Carry is the basic concept that any individual who is a lawful gun owner can legally carry a firearm openly or concealed, without asking the government for permission.

"Today, I introduced HR 9534, the National Constitutional Carry Act," Massie posted on X. "No one should have to beg the government to exercise a constitutionally protected right anywhere in the country."

The text of Massie's law indicated that "No State or political subdivision of a State may impose a criminal or civil penalty on, or otherwise indirectly dissuade the carrying of firearms (including by imposing a financial or other barrier to entry) in public by residents or nonresidents of that State who are citizens of the United States and otherwise eligible to possess firearms under State and Federal law."

The term "constitutional carry," which is sometimes called unrestricted carry or "Vermont carry" due to the state's nature of neither requiring nor issuing permits for open or concealed carry, is partially derived from a view of the Second Amendment that interprets the provision as broadly as possible. According to the U.S. Concealed Carry Association, the term means that the state's law does not prohibit citizens who can legally possess a firearm from carrying handguns – meaning, no state permit is required.

"Sometimes, constitutional carry may be conditional such as in those states that have no laws prohibiting the open carry of a handgun but which require a permit to carry the handgun concealed," the group said on its website.

Meanwhile, the National Association for Gun Rights (NAGR) lauded Massie after the bill was introduced.

"This is the only bill that will ensure all law-abiding Americans can enjoy Real Constitutional Carry without being subjected to outrageous New York-style permit regulations, expensive fees, or ATF intervention on the right to carry," stated Dudley Brown, NAGR president.

"Thomas Massie is a gun rights champion, and we support the Real Constitutional Carry bill 100 percent," declared Brown. "The right of law-abiding citizens to carry a firearm to protect themselves and their families has been chipped away by gun control zealots for decades. But just in the last ten years, grassroots efforts by NAGR members have gotten Constitutional Carry passed in over two dozen states and it's time all 50 states enjoy the same freedoms."

Americans in 28 states can legally carry a gun without having to pay fees, do paperwork or do any other work associated with gaining a permit. On July 4, Louisiana became the latest state to legalize constitutional carry. (Related: Louisiana becomes 28th state to pass permitless concealed carry legislation.)

Massie's new legislation would extend that liberty to individuals in every state of the U.S., thereby restoring the right to bear arms that are enshrined in the Second Amendment, Big League Politics' Jose Alberto Nino said.

Massie criticizes Speaker Johnson's spending plan

Meanwhile, the Kentucky congressman slammed House Speaker Mike Johnson (R-LA) after it was revealed that the GOP leader will bring up a funding bill for consideration.

"Like an undead but doomed zombie, the CR+Save Act is back," Massie wrote or X. "Speaker Johnson is fake fighting by attaching a bright shiny object (that he will later abandon) to a bill that continues our path of destructive spending. I won't be any part of this insulting charade. I'm a hell no."

Massie is one of the members in the Republican conference who have come out against Johnson's funding strategy to keep the government open past Sept. 30. He also joined Rep. Marjorie Taylor Greene (R-GA) in the call to oust Johnson from his speakership earlier this year.

Johnson previously announced plans to move forward with a stopgap plan to kick the September funding deadline into March, while also attaching a partisan bill pushing for stricter proof-of-citizenship requirements in elections.

"Congress has an immediate obligation to do two things: responsibly fund the federal government and ensure the security of our elections because we owe this to our constituents, we will move forward on Wednesday with a vote on the 6-month CR with the SAVE Act attached," Johnson said.

Republican leaders had previously planned to vote on the funding bill earlier this month. In remarks on X, Greene described Johnson's strategy as a "classic bait and switch that will enrage the base, only one month before the election, when they find out they have been tricked and let down again."

"The only way to make the [Safeguard American Voter Eligibility] SAVE Act a law would be to refuse to pass a CR until the Senate agrees to pass the SAVE Act and Biden agrees to sign it into law," she wrote on X. "This would force a Gov shutdown on Oct 1 because Biden and Schumer both said they will shut down the government as they are that adamant against the SAVE Act."
