Twenty-one states have joined Louisiana's lawsuit against the federal government, challenging the U.S. Food and Drug Administration's (FDA) relaxation of abortion pill regulations. The policy, enacted under the Biden administration, eliminated the requirement for in-person dispensing of abortion drugs, allowing them to be distributed via mail—a move that has led to severe medical complications and infringed on state sovereignty.

The lawsuit, filed last fall, accuses the FDA of violating Louisiana's abortion laws and causing preventable harm to women, including plaintiff Rosalie Markezich, who suffered lasting trauma after being coerced into an unwanted abortion.

Women harmed by mail-order abortion pills

Rosalie Markezich's case highlights the dangers of unsupervised chemical abortions. According to the lawsuit, her boyfriend obtained abortion drugs through the U.S. Postal Service from a California doctor—despite Markezich not consenting to the procedure.

"Far from empowering Rosalie to make her own choice and preserving her autonomy, mail-order abortion drugs had Rosalie feeling trapped and terrified," the lawsuit states. "She grieves the loss of her child and endures lasting emotional trauma."

Medical professionals warn that complications from abortion pills are alarmingly common. Dr. Christina Francis, CEO of the American Association of Pro-Life Obstetricians and Gynecologists, testified that mail-order abortions amount to "medical negligence," citing cases of hemorrhage, sepsis and incomplete abortions requiring emergency surgery.

Data reveals that one in ten women suffers life-threatening complications—22 times higher than the FDA's claimed 0.5% risk. Emergency room visits for telemedicine abortions are three times higher than for in-person procedures.

State sovereignty under attack

Louisiana argues that the FDA's policy "directly violates Louisiana's abortion laws and prevents Louisiana from protecting the lives of unborn babies despite the promise of Dobbs." The state also contends that the rule change has overwhelmed emergency rooms with abortion-related complications, straining public resources.

On Feb. 13, Alabama, Alaska, Arkansas, Georgia and 17 other states filed an amicus brief supporting Louisiana, asserting that the FDA's actions infringe on their constitutional right to protect prenatal life.

"Like Louisiana, amici States believe that the Biden Administration's attempt to establish a nationwide abortion standard is an attack on state sovereignty," the brief states. "The Constitution does not allow the federal government to dictate every nook and cranny of daily life."

South Carolina Attorney General Alan Wilson emphasized the broader implications: "What good does it do for one state to pass a law banning something, like chemical abortion drugs, if another state is still allowed to mail them into our state?"

Trump FDA delays action amid growing pressure

Despite the mounting legal and political backlash, the Trump administration's FDA has urged the court to delay ruling on Louisiana's lawsuit, citing an ongoing internal review of abortion pill regulations. The agency claims that restoring in-person dispensing requirements could render the lawsuit unnecessary.

However, pro-life leaders are skeptical. Last week, Sen. Josh Hawley (R-MO) met with FDA officials and declared, "I just don't think that review is even underway."

The FDA insists it is carefully evaluating data, but critics accuse the agency of stalling to protect Big Pharma profits and abortion industry interests.

Planned Parenthood expands abortion-on-demand

Mail-order abortion pills have become the abortion lobby's most effective tool for circumventing pro-life laws. Planned Parenthood's latest annual report reveals that despite the overturning of Roe v. Wade, the organization committed 392,715 abortions in the most recent reporting period—a record high, accounting for 40% of all U.S. abortions.

Chemical abortions now dominate the industry, with abortion providers exploiting lax FDA regulations to push dangerous drugs into pro-life states.

Congressional Republicans demand accountability

Over 170 congressional Republicans have demanded the Trump administration reinstate strict FDA safety protocols for abortion pills, reversing Biden-era policies that removed medical oversight.

"Mail-order abortion is a reckless experiment on women's lives," said Rep. Marjorie Taylor Greene (R-GA). "The FDA has betrayed its duty to protect public health by allowing these deadly drugs to be shipped like Amazon packages."

As the legal battle intensifies, pro-life advocates warn that without swift action, more women will suffer—and more states will see their laws undermined by federal overreach.
