As per the Post Millennial, Trump faces four criminal prosecutions – two under the Biden administration's Department of Justice, one served by Manhattan District Attorney (DA) Alvin Bragg in New York and another by Fulton County DA Fani Willis in Georgia. The former president himself has denounced these unfair prosecutions as "witch hunts," while many have called the cases against the real estate mogul as "political prosecution."
"The more unfair the attacks on Trump seem to the public, the higher he will rise in the polls," Musk wrote. His post was a reply to Mike Benz, executive director for the Foundation for Freedom Online (FFO). According to Benz, two personalities in Trump's hush money trial – which stemmed from payments made to adult film star Stormy Daniels – were problematic.
The FFO executive director pointed out that New York State Supreme Court Acting Justice Juan Merchan, who oversees the hush money trial, is "financially conflicted." He also blasted former Trump attorney-turned-prosecution star witness Michael Cohen, calling him "a multi-crime convicted felon who, [in] most states, wouldn't even be allowed to vote."
In turn, Benz's post was a reply to an earlier post by venture capitalist Blake Masters, who is running as a candidate to represent Arizona in the U.S. Congress. He also pointed to the absurdity of the ongoing hush money trial against Trump. "It's hard to put into words the staggering corruption of Bragg's kangaroo court in New York City," Masters wrote.

According to Masters, Bragg "lowers half of all felonies to misdemeanors yet raised a misdemeanor to a felony in order to indict Trump." Two of the lead prosecutors also had clear conflicts of interest.
One lead prosecutor previously served as a consultant for the Democratic National Committee, and was the No. 3 official at the Biden administration's Department of Justice before Bragg hired him to go after Trump. The other lead prosecutor donated over $1,000 to the Biden campaign and the Democratic political action committee ActBlue in 2020.
According to the Post Millennial, Bragg has elevated 34 charges of falsification of business records – considered misdemeanors – to Class E felonies. However, he has not said what felony he believes those misdemeanors were in service to. Ironically, Bragg – a Democrat – has had a history of refusing to prosecute violent criminals in the Big Apple.
Benz pointed out that Cohen is a convicted felon who has lied to Congress and [has] been found guilty of tax evasion. Masters also attested to this, calling the former Trump attorney "a convicted perjurer who is selling T-shirts of Trump in jail on TikTok."
Both Masters and Benz were equally critical of the judge and Biden donor, as his daughter Loren Merchan is a Democratic operative who has used the hush money trial to raise funds for the party. The younger Merchan, a left-wing activist, works in marketing for Democratic causes and on behalf of Democratic candidates through the Chicago-based Authentic Campaigns. "This whole thing is a joke, and [it] wouldn't be happening if [former] President Trump wasn't leading in every swing state poll," Masters ultimately concluded. In contrast, Musk favors neither candidate.
"I would not vote for Biden," the South African-born tech mogul said in an interview. He has also declined to donate funds to either presidential candidate.
