Amendments to Spain’s Penal Code seek to IMPRISON parents who oppose their kids’ gender surgeries
By Ramon Tomey // Jun 30, 2025

  • Spain's lower house of parliament approved amendments to the Penal Code that could imprison parents, doctors and educators for up to two years if they resist irreversible gender transition procedures for minors, including delaying medicalization for evaluation. Professionals opposing "gender-affirming care" risk losing their licenses.
  • The bill passed with near-unanimous support, even from previously critical parties like Spain's Popular Party, leaving conservative voters disillusioned. Only the Vox party voted against it.
  • A proposed Austrian law would fine or jail parents (up to €30,000 or one year) for questioning a minor's gender identity, and even strip parental rights if they oppose medical interventions like surgery or hormones.
  • Critics warn these laws invert medical ethics – prioritizing ideology over child protection – despite rising cases of mastectomies and transition-related regret. Historical precedents (e.g., forced sterilizations) underscore concerns about state-mandated medical coercion.

Spain is advancing legislation that could imprison parents, doctors and educators who resist irreversible gender transition procedures for minors.

On Wednesday, June 25, Spain's Congress of Deputies (the country's lower house of parliament) overwhelmingly approved amendments to the Spanish Penal Code. According to the amendments, those opposing gender-related medical interventions for minors could face jail time of up to two years.

The sweeping language of the Penal Code's amendments criminalizes any opposition to "gender-affirming care," including psychological evaluations delaying medicalization. Aside from jail time, penalties for parents, doctors, psychologists or educators who do not support so-called "affirmative therapies" could lose their license for standing up against the transgender establishment.

"They call it 'conversion therapy' when you refuse to administer puberty blockers without proper evaluation," lamented Spanish criminal lawyer Paula Fraga. "This is ideological persecution backed by criminal law."

The bill received support from all parliamentary groups, including the Popular Party. Its complete 180 from being critical of gender ideology to supporting the proposal has left conservative voters disillusioned. The Vox parliamentary group was the only faction that voted against the proposal, while the Navarrese People's Union abstained.

Protecting kids now a crime? The global assault on parenting

Meanwhile, a proposed law in Austria would impose fines of up to €30,000 ($35,180) or a year in jail for questioning a minor's "gender identity." It also goes further by stripping parents of legal authority if they oppose genital surgeries or hormone treatments. The proposal, backed by the Social Democratic Party (SPO) and Liberal NEOS Party, effectively criminalizes parental caution. Initially linked to the draft, the SPO now deflects blame. Verified documents confirm its existence, however.

"Logic is being turned on its head. Protecting children from permanent harm may now be a crime," warned psychiatrist Bettina Reiter. Medical data reveals alarming trends, backing up her concerns. From a mere four mastectomies in 2011, that number has surged to 128 in 2023 – with rising reports of regret.

These measures mark a drastic departure from historical medical ethics, where protecting children from irreversible harm was paramount. Critics argue the law conflates ethical hesitations with coercion, removing protections for minors who may later regret transitioning.

Historically, such state-enforced medical mandates evoke darker precedents. From compulsory sterilization programs to lobotomies, governments have weaponized medicine under ideological pretexts. Today, dissenting parents and professionals face similar coercion, framed as "progress."

The implications are profound. If enacted, these laws will embolden activists globally, pressuring other nations to adopt similar measures. Europe's legislative shift signals an accelerating erosion of parental rights and medical ethics.

Ultimately, these policies prioritize ideology over evidence, punishing those who defend childhood innocence. The irony is grim. Regimes claiming to champion "human rights" now legislate against humanity's most fundamental instinct – protecting children.
