DOJ special counsel report describes Biden as having “diminished faculties” and “faulty memory” – proving critics right that he is in a state of COGNITIVE DECLINE
By Arsenio Toledo // Feb 12, 2024

The Department of Justice's (DOJ) special counsel report regarding allegations that President Joe Biden mishandled classified documents has described him as having "diminished" mental faculties.

The investigation against Biden comes from allegations that he mishandled classified documents by knowingly keeping them after his term as vice president ended in 2017.

Following a 15-month investigation, Justice Department Special Counsel Robert Hur has decided against bringing criminal charges against the president, writing in his report that it would be difficult to convince jurors that Biden "willfully" kept classified documents. "We have also considered that, at trial, Mr. Biden would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory," wrote Hur in his assertion that jurors were unlikely to vote to convict the president.

This report should have been an unequivocal legal exoneration, and Democrats should have been able to use the report as a victory against critics claiming that Biden is in a state of cognitive decline.

Instead, as New York Times White House correspondent Michael D. Shear describes it, Hur's report has been "a political disaster" for the president.

Hur's 345-page report, which details his investigation that included interviews with Biden, claimed that Biden had "diminished faculties" and a "faulty memory" during five hours worth of interviews held over two days. He claimed that Biden had "significant limitations" in his ability to recall certain events.

Hur: Biden couldn't remember what years he served as VP, when his son Beau died

Among Hur's assertions, he claimed that Biden could not remember what years he served as vice president and, in one instance, "he did not remember, even within several years, when his son Beau died."

Speaking to reporters from the White House's Diplomatic Reception Room on Feb. 8 after the report's release, Biden strongly criticized Hur and accused him and the report's other authors of "extraneous commentary" regarding his age and mental capacity.

"They don't know what they're talking about," said the president. He appeared to take special exception at Hur's claim that he could not remember when Beau died."

"How the hell dare he raise that," said Biden. "Every Memorial Day, we hold a service remembering him attended by friends and family and the people who loved him. I don't need anyone, I don't need anyone to remind me when he passed away."

Beau Biden, the president's eldest child and a veteran of the Delaware Army National Guard – including serving for at least a year deployed in Iraq – died of an aggressive form of brain cancer in 2015, possibly caused by lengthy exposure to toxic chemicals during his deployment.

In a follow-up written statement, Biden claimed that he was distracted during the five hours of in-person interviews – held over two days on Oct. 8 and 9 – because Hamas had just attacked Israel on Oct. 7.

"I was in the middle of handling an international crisis," the president wrote. "I just believed that's what I owed the American people."
