The House passed the measure by 219 votes in favor and 203 votes against, with another 13 not voting. The vote was entirely by party line, which means only Republicans in the House voted in favor of the bill.
The bill amends the civil rights law known as Title IX to properly define sex as being "based solely on a person's reproductive biology and genetics at birth." It also calls for prohibiting schools that receive federal financial assistance from operating athletic activities that allow transgender women and girls from joining female sports teams.
The bill does not block female-to-male transgenders from training or practicing with biologically female athletes in their respective athletic programs "so long as no female is deprived of a roster spot on a team or sport, opportunity to participate in a practice or competition, scholarship, admission to an education institution" or other benefits.
"This is about protecting women's sports now and into the future," said Rep. Elise Stefanik of New York, chair of the House Republican Conference and the highest-ranking female GOP member in the chamber.
"They're males, sorry," said Rep. Virginia Fox of North Carolina, the chair of the House Education Committee and one of the bill's 93 Republican co-sponsors. She added that so-called transgender people do not exist and that it is impossible for a person to live as a sex that is different from what a person is born with.

"Biological women and girls should only be competing against other biological women and girls," said Rep. Beth Van Duyne of Texas. "And I don't care how many surgeries you have, I don't care how many chemicals you put into your body. You're not going to be a biological woman."
Despite the victory in the House, the bill is unlikely to pass in the Democrat-controlled Senate, and President Joe Biden himself has vowed to veto the bill if it did happen to pass, claiming that the bill discriminates against children. "This is the same progressive Left … who won't let your kids have soda machines in public schools because they're getting too fat, who wants to put every TV show warnings about people smoking or drinking alcohol," commented Duke Pesta on The New American. "This is the progressive Left who wants everything for children completely regulated – except sex [and gender]."
Many of the Democrats in the House claim that they are the ones who are defending children, arguing that the bill does not in fact make school sports safer and more equitable for women and young girls.
"Don't believe for a minute that this is about protecting women and girls, because if Republicans cared about that, they would not be voting against equal pay, against paid sick leave, against universal childcare," said Rep. Pramila Jayapal of Washington, one of the co-chairs of the House Equality Caucus. She has a transgender daughter.
"The way that this bill targets children in the name of gender equality is insulting," she added. She also questioned how the proposed law would be enforced. "If a young girl – if your daughter – doesn't look feminine enough, is she subject to an examination?"
The Democrats, Biden and his Department of Education have proposed an alternative that would prohibit schools from banning transgender children from playing on the teams of their chosen gender, with exceptions only possible for the highest levels of competition. Biden is also proposing amending Title IX to include discrimination protections for sexual orientation and gender identity.
