The dilemma of Atlanta’s state police: What to do with 10,000 confiscated guns?

10,000 confiscated guns and counting. The Atlanta state police has been placed into a very uncomfortable spot. They took the guns off the street. The law states that the guns must be disposed within 6 months of confiscation. It is prohibited to destroy the guns.

Even city mayor Kasim Reed admits to be undecided on the situation.

“It’s very difficult for me to lead on this, because even in the state of Georgia, when we take illegal guns off the street, under Georgia state law right now, we actually have to return them or make them available to the public in some form”.

The state law in question is Senate Bill 350. It is a state law that makes destroying confiscated weapons illegal. The law dictates that the confiscated guns should be returned to “innocent owners”. When it is not possible, the weapons should be auctioned off to the public.

Atlanta police Chief George Turner admitted that the police are obligated to return, auction, or sell the firearms, but it would be “catastrophic” to public safety.

So they haven’t done any of the suggested actions.

Former state Senator Don Balfour, one of the law’s authors, believes the city is breaking the law. “The law says what the law is. I don’t know how you go around that.”
