Gingrich noted that mail-in and absentee ballots were cast in "unprecedented" numbers in the elections, with an expectation that this would result in higher numbers of ballots rejected for various issues. This was not the case in battleground states such as Pennsylvania, which only had 0.03 percent of mail-in ballots rejected – which translated to about 1,000 votes.
The former speaker added that "explosive new litigation filed in federal district court" outlines a variety of actions used to inflate the number of votes Democratic presidential nominee Joe Biden got. These included different treatment of voters based on where they live and outright manipulation of Pa.'s voter registration system by partisan activists.
In his piece, Gingrich explained how Biden "benefited handsomely" from mail-in voting. Democrat-controlled areas in Pa. such as the Allegheny, Philadelphia and Delaware counties had election officials who overstepped their authority to give voters preferential treatment – which those in Republican-leaning areas never received.
Election workers illegally "pre-canvassed" mail-in ballots to determine whether they lacked a secrecy envelope or necessary information. Voters were given a chance to rectify their ballots if found deficient: Democratic Party officials were even given contact details to reach out to voters about curing their ballots. Meanwhile, election officials in GOP-leaning counties rightly interpreted this as a violation of the state's election code. Pa. Secretary of State Kathy Boockvar also played a role in the scheme to ensure a Biden victory. The Democrat secretary issued guidance permitting the illegal practices in Democratic counties despite lacking the statutory authority to do so. In addition, she granted private, partisan organizations – such as the pro-Democratic Party group Rock the Vote – access to the Statewide Uniform Registry of Electors (SURE).
According to the federal district court lawsuit Gingrich referenced, Boockvar said that Rock the Vote linked its web tool to SURE in order to make "the process of registering … seamless for votes" across the state. The former speaker clarified that only election clerks are allowed to enter voter information directly into the records, not private partisan groups.
Because of Boockvar's authorization of private parties to access SURE, many suspicious named appeared in post-election voter lists. Gingrich commented that Rock the Vote's intrusion in the SURE system was "direct evidence of a systematic effort to conceal wrongdoing." The former presidential candidate called to stop further alterations to the system before any more evidence can be destroyed, exhorting judges to issue similar injunctions. "We can't allow that to happen, or we may never be able to trust the integrity of our elections again," he concluded.
The Trump campaign team spearheaded by Rudy Giuliani and Jenna Ellis have filed lawsuits pointing out the alleged election fraud in different swing states, including Pennsylvania. Giuliani himself has expressed his willingness to stamp out vote fraud in the state, saying: "I don't know if this is going on any other place, [but] what it says to me is this [vote fraud] is a concerted effort of the crooks who run the Democratic Party."
